नई दिल्ली/जीजेडी न्यूज: इस्लामाबाद उच्च न्यायालय (आईएचसी) ने गुरुवार को कहा कि भारतीय नागरिक कुलभूषण जाधव को “निष्पक्ष सुनवाई के अधिकार” से वंचित नहीं किया जा सकता है। पाकिस्तान न्यूज डेली डॉन की एक रिपोर्ट के अनुसार इस्लामाबाद उच्च न्यायालय ने कहा, “चूंकि भारतीय जासूस कुलभूषण जाधव एक इंसान हैं, इसलिए उन्हें निष्पक्ष सुनवाई के अधिकार से वंचित नहीं किया जा सकता है।”
IHC ने भारत को पाकिस्तान में अपने राजनयिक मिशन के माध्यम से, मृत्युदंड कैदी कुलभूषण जाधव के लिए 13 अप्रैल तक एक वकील नियुक्त करने का निर्देश दिया, ताकि उनकी सजा के मामले की समीक्षा की जा सके।
भारतीय नौसेना के 51 वर्षीय सेवानिवृत्त अधिकारी जाधव को अप्रैल 2017 में एक पाकिस्तानी सैन्य अदालत ने जासूसी और आतंकवाद के आरोप में मौत की सजा सुनाई थी।
सजा के आधार पर, भारत ने जाधव को उनकी मौत की सजा को चुनौती देने के लिए कांसुलर एक्सेस से इनकार करने के लिए पाकिस्तान के खिलाफ अंतर्राष्ट्रीय न्यायालय (ICJ) का दरवाजा खटखटाया।
पाकिस्तान के अटॉर्नी जनरल खालिद जावेद खान ने अंतर्राष्ट्रीय न्यायालय (समीक्षा और पुनर्विचार) अधिनियम 2021 के अनुसार IHC को सूचित किया कि संबंधित राज्य के मिशन का एक कांसुलर अधिकारी एक सेना द्वारा दी गई सजा की समीक्षा के लिए अदालत के समक्ष याचिका दायर कर सकता है। दूसरे देश में अपने नागरिक के लिए अदालत।
खान ने अदालत से यह भी कहा कि भारत जानबूझकर मामले में देरी कर रहा है ताकि उसे आईसीजे के दरवाजे पर दस्तक देने का मौका मिल सके और शिकायत की जा सके कि पाकिस्तान जाधव को समीक्षा का अवसर प्रदान करने के अपने फैसले का उल्लंघन कर रहा है।
नवंबर 2021 में, पाकिस्तान की संसद ने जाधव को सैन्य अदालत द्वारा उनकी दोषसिद्धि के खिलाफ समीक्षा अपील दायर करने का अधिकार देने के लिए एक कानून बनाया।
