सीजेआई डीवाई चंद्रचूड़ शपथ ग्रहण: ‘भारत के सभी नागरिकों की रक्षा करेंगे’: न्यायमूर्ति डी वाई चंद्रचूड़ ने 50 वें सीजेआई के रूप में शपथ ली
शपथ लेने के बाद जस्टिस चंद्रचूड़ ने सुप्रीम कोर्ट में महात्मा गांधी की प्रतिमा पर श्रद्धांजलि दी और कहा कि देश की सेवा करना उनकी प्राथमिकता है।
नई दिल्ली: सुप्रीम कोर्ट के न्यायाधीश धनंजय यशवंत चंद्रचूड़ ने बुधवार को भारत के 50 वें मुख्य न्यायाधीश के रूप में शपथ ली, जो न्यायमूर्ति यूयू ललित की जगह लेंगे, समाचार एजेंसी एएनआई की रिपोर्ट। राष्ट्रपति द्रौपदी मुर्मू ने राष्ट्रपति भवन में भारत के मुख्य न्यायाधीश के पद की शपथ दिलाई। जस्टिस चंद्रचूड़ का कार्यकाल 10 नवंबर, 2024 तक कार्यालय में रहेगा।
शपथ लेने के बाद जस्टिस चंद्रचूड़ ने सुप्रीम कोर्ट में महात्मा गांधी की प्रतिमा पर श्रद्धांजलि दी और कहा कि देश की सेवा करना उनकी प्राथमिकता है।
CJI ने कहा, “राष्ट्र की सेवा करना मेरी प्राथमिकता है। हम भारत के सभी नागरिकों की रक्षा करेंगे, चाहे वह तकनीक या रजिस्ट्री सुधारों या न्यायिक सुधारों के मामले में हो।”
उन्होंने अपने पिता जस्टिस वाईवी चंद्रचूड़ के 2 फरवरी 1978 से 11 जुलाई 1985 तक देश के 16वें मुख्य न्यायाधीश बनने के 44 साल बाद यह पद संभाला।
13 मई, 2016 को सर्वोच्च न्यायालय में न्यायाधीश के रूप में नियुक्ति से पहले, न्यायमूर्ति चंद्रचूड़ 31 अक्टूबर, 2013 से इलाहाबाद उच्च न्यायालय में मुख्य न्यायाधीश थे।
62 वर्षीय न्यायमूर्ति चंद्रचूड़ इलाहाबाद उच्च न्यायालय में मुख्य न्यायाधीश के रूप में नियुक्ति से पहले बंबई उच्च न्यायालय के न्यायाधीश भी थे।
उन्होंने 1998 से बॉम्बे हाई कोर्ट में जज के रूप में अपनी नियुक्ति तक भारत के अतिरिक्त सॉलिसिटर जनरल के रूप में भी काम किया था। उन्हें जून 1998 में बॉम्बे हाईकोर्ट द्वारा एक वरिष्ठ अधिवक्ता के रूप में नामित किया गया था।
जस्टिस चंद्रचूड़ ने जस्टिस यूयू ललित का स्थान लिया है। जस्टिस ललित ने 11 अक्टूबर को कन्वेंशन के मुताबिक जस्टिस डीवाई चंद्रचूड़ के नाम की सिफारिश केंद्र के उत्तराधिकारी के तौर पर की थी. राष्ट्रपति मुर्मू ने उन्हें 17 अक्टूबर को अगले सीजेआई के रूप में नियुक्त किया था। केंद्रीय कानून मंत्रालय ने हाल ही में अगले सीजेआई की नियुक्ति के लिए प्रक्रिया शुरू की थी, जिसमें निवर्तमान सीजेआई को उनके उत्तराधिकारी की सिफारिश करने के लिए कहा गया था।
विशेष रूप से, व्यक्तिगत स्वतंत्रता के संबंध में उनके निर्णय महत्वपूर्ण रहे हैं। व्यभिचार के लिए आईपीसी की धारा 497 को रद्द करते हुए दिए अपने फैसले में उन्होंने लिखा कि एक विवाहित महिला को भी अपनी स्वायत्तता है। उसे अपने पति की संपत्ति के रूप में नहीं देखा जा सकता है। उसका किसी अन्य पुरुष के साथ संबंध होना तलाक के लिए एक वैध आधार हो सकता है, लेकिन किसी अन्य व्यक्ति को जेल में डालना अपराध के रूप में मानना गलत होगा।
हाल ही में उन्होंने अविवाहित महिलाओं को 20 से 24 सप्ताह तक गर्भपात करने की अनुमति भी दी। इस ऐतिहासिक फैसले में उन्होंने यह भी कहा कि अगर किसी पति ने अपनी पत्नी को जबरन यौन संबंध बनाकर गर्भवती किया है तो उसे भी 24 सप्ताह तक गर्भपात का अधिकार होगा। इस तरह गर्भपात के मामले ने ही कानून में पहली बार वैवाहिक बलात्कार को मान्यता दी।
