बाबरी विध्वंस केस : बीजेपी नेता आडवाणी, जोशी सहित सभी 32 आरोपी बाइज्जत बरी
पिछले 28 सालों से खिंच रहे इस केस में एक के बाद एक कानूनी पेचीदगियां आई हैं और इंसाफ का रास्ता और मुश्किल ही हुआ है.
लखनऊ:
बाबरी का विवादित ढांचा ढहाए जाने को लेकर लखनऊ की स्पेशल कोर्ट ने सोमवार को बड़ा फैसला सुनाया। लखनऊ की स्पेशल सीबीआई कोर्ट ने मामले में फैसला सुनाते हुए आडवाणी, जोशी, उमा, कल्याण, नृत्यगोपाल दास सहित सभी 32 आरोपियों को बरी कर दिया है। अयोध्या में भले ही राम भक्तों की जीत हुई, लेकिन अभी एक और अहम फैसला आना बाकी है। अयोध्या में एक तरफ राम मंदिर का निर्माण शुरू हो गया है, वहीं इस विवादित ढांचा गिराने के मामले में आज फैसला आना है। 28 साल पहले 6 दिसंबर 1992 को अयोध्या में कार सेवकों ने बाबरी मस्जिद का ढांचा गिरा दिया था। ढांचा गिराने का आरोप भाजपा के वरिष्ठ नेता लालकृष्ण आडवाणी, मुरली मनोहर जोशी जैसी हस्तियों समेत 48 लोगों पर लगा था। इनमें से 16 की मौत हो चुकी है। सीबीआई की स्पेशल कोर्ट 32 आरोपियों की किस्मत का आज फैसला सुनाएगी।
ये थे इस केस के 32 आरोपी
भाजपा के वरिष्ठ नेता लालकृष्ण आडवाणी, मुरली मनोहर जोशी, कल्याण सिंह, उमा भारती, विनय कटियार, साध्वी ऋतंभरा, महंत नृत्य गोपाल दास, डॉ. राम विलास वेदांती, चंपत राय, महंत धर्मदास, सतीश प्रधान, पवन कुमार पांडेय, लल्लू सिंह, प्रकाश शर्मा, विजय बहादुर सिंह, संतोष दुबे, गांधी यादव, रामजी गुप्ता, ब्रज भूषण शरण सिंह, कमलेश त्रिपाठी, रामचंद्र खत्री, जय भगवान गोयल, ओम प्रकाश पांडेय, अमरनाथ गोयल, जयभान सिंह पवैया, साक्षी महाराज, विनय कुमार राय, नवीन भाई शुक्ला, आरएन श्रीवास्तव, आचार्य धर्मेंद्र देव, सुधीर कुमार कक्कड़ और धर्मेंद्र सिंह गुर्जर।

विवादित ढांचा गिराने के मामले में पहली एफआईआर मुकदमा संख्या 197/92 को प्रियवदन नाथ शुक्ल ने शाम 5:15 पर बाबरी मस्जिद ढहाने के मामले में तमाम अज्ञात लोगों के खिलाफ धारा 395, 397, 332, 337, 338, 295, 297 और 153ए में मुकदमा दर्ज किया।

इस मामले में दूसरी एफआईआर मुकदमा संख्या 198/92 को चौकी इंचार्ज गंगा प्रसाद तिवारी की तरफ से आठ नामजद लोगों के खिलाफ दर्ज किया गया, जिसमें भाजपा के लालकृष्ण आडवाणी, उमा भारती, डॉ. मुरली मनोहर जोशी, तत्कालीन सांसद और बजरंग दल प्रमुख विनय कटियार, तत्कालीन वीएचपी महासचिव अशोक सिंघल, साध्वी ऋतंभरा, विष्णु हरि डालमिया और गिरिराज किशोर शामिल थे। इनके खिलाफ धारा 153ए, 153बी, 505 में मुकदमा लिखा गया।बाद में जनवरी 1993 में 47 अन्य मुकदमे दर्ज कराए गए, जिनमें पत्रकारों से मारपीट और लूटपाट जैसे आरोप थे।
विवादित ढांचा गिराने के मामले में1993 में इलाहाबाद हाईकोर्ट के आदेश पर लखनऊ में विशेष अदालत बनाई गई थी, जिसमें मुकदमा संख्या 197/92 की सुनवाई होनी थी। इस केस में हाईकोर्ट की सलाह पर 120बी की धारा जोड़ी गई, जबकि मूल एफआईआर में यह धारा नहीं जोड़ी गई थी। अक्टूबर 1993 में सीबीआई ने अपनी चार्जशीट में 198/92 मुकदमे को भी जोड़कर संयुक्त चार्जशीट फाइल की। क्योंकि दोनों मामले जुड़े हुए थे।
जब उसी आरोप पत्र में विवेचना में आए नाम बाल ठाकरे, नृत्य गोपाल दास, कल्याण सिंह, चम्पत राय जैसे 48 नाम जोड़े गए। केस से जुड़े वकील मजहरुद्दीन बताते हैं कि सीबीआई की सभी चार्जशीट मिला लें तो दो से ढाई हजार पन्नों की चार्जशीट रही होगी।
यूपी सरकार की एक गलती से अलग-अलग जिलों में हुई सुनवाई
अक्टूबर 1993 में जब सीबीआई ने संयुक्त चार्जशीट दाखिल की तो कोर्ट ने माना कि दोनों केस एक दूसरे से जुड़े हुए हैं। इसलिए दोनों केस की सुनवाई लखनऊ में बनी विशेष अदालत में होगी, लेकिन लालकृष्ण आडवाणी समेत दूसरे आरोपियों ने इसे हाईकोर्ट में चुनौती दे दी।
उस दलील में कहा गया कि जब लखनऊ में विशेष कोर्ट का गठन हुआ तो अधिसूचना में मुकदमा संख्या 198/92 को नहीं जोड़ा गया था। इसके बाद हाईकोर्ट ने सीबीआई को आदेश दिया कि मुकदमा संख्या 198/92 में चार्जशीट रायबरेली कोर्ट में फाइल करे।
जब इलाहाबाद हाईकोर्ट ने 2005 में रायबरेली कोर्ट का आर्डर रद्द किया
2003 में सीबीआई ने चार्जशीट तो दाखिल की, लेकिन आपराधिक साजिश की धारा 120 बी नहीं जोड़ सके। चूंकि, दोनों मुकदमे अलग थे, ऐसे में रायबरेली कोर्ट ने आठ आरोपियों को इसलिए बरी कर दिया, क्योंकि उनके खिलाफ मुकदमे में पर्याप्त सबूत नहीं थे। इस मामले में दूसरा पक्ष हाईकोर्ट चला गया तो इलाहाबाद हाईकोर्ट ने 2005 में रायबरेली कोर्ट का आर्डर रद्द किया और आदेश दिया कि सभी आरोपियों के खिलाफ मुकदमा चलता रहेगा।
जब 2007 से शुरू हुआ था ट्रायल, तब हुई थी पहली गवाही
इसके बाद मामले में ट्रायल शुरू हुआ और 2007 में पहली गवाही हुई। केस से जुड़े वकील केके मिश्रा बताते हैं कि कुल 994 गवाहों की लिस्ट थी, जिसमें से 351 की गवाही हुई। इसमें 198/92 मुकदमा संख्या में 57 गवाहियां हुईं, जबकि मुकदमा संख्या 197/92 में 294 गवाह पेश हुए। कोई मर गया, किसी का एड्रेस गलत था तो कोई अपने पते पर नहीं मिला।
सुप्रीम कोर्ट ने जून 2017 में एक साथ मामले की सुनवाई के दिए आदेश
जब हाईकोर्ट के फैसले के खिलाफ 2011 में सीबीआई सुप्रीम कोर्ट गई। अपनी याचिका में उसने दोनों मामलों में संयुक्त रूप से लखनऊ में बनी विशेष अदालत में चलाने और आपराधिक साजिश का मुकदमा जोड़ने की बात कही थी। तब सुप्रीम कोर्ट में सुनवाई चलती रही। जून 2017 में हाईकोर्ट ने सीबीआई के पक्ष में फैसला सुनाया।

आपको बता दें कि 6 दिसंबर 1992 के 10 दिन बाद केंद्र सरकार ने लिब्रहान आयोग का गठन कर दिया गया था, जिसे तीन महीने में अपनी रिपोर्ट इस मामले सौंपनी थी, लेकिन आयोग की जांच पूरी होने में 17 साल का समय लग गया। इस दौरान लगभग 48 बार आयोग को विस्तार मिला।
बीजेपी नेता आडवाणी-उमा समेत पांच नेता नहीं रहेंगे मौजूद
बाबरी विध्वंस केस पर फैसले के समय पांच आरोपी बीजेपी नेता लालकृष्ण आडवाणी, मुरली मनोहर जोशी, उमा भारती, शिवसेना के सांसद रहे सतीश प्रधान, श्रीराम जन्मभूमि तीर्थ क्षेत्र ट्रस्ट के अध्यक्ष महंत नृत्यगोपाल दास मौजूद नहीं रहेंगे। इसके अलावा पूर्व मुख्यमंत्री कल्याण सिंह कोर्ट में पेश होने के लिए लखनऊ पहुंच चुके हैं। बीते दिनों वे कोरोना की चपेट में आ गए थे, जिसके बाद से उनका इलाज चल रहा था।
